Terms of Service

These terms govern the use of the Waterzy website, the Waterzy vendor app and the Waterzy WhatsApp ordering service (together, the “Service”), operated by Waterzy, Ernakulam, Kerala, India (“Waterzy”, “we”, “us”). By using the Service you agree to these terms and to our Privacy Policy at https://www.waterzy.in/privacy.

1. What Waterzy is

Waterzy is a software platform for packaged-drinking-water vendors. A vendor uses the Waterzy app to record orders, customers, deliveries, bills, payments, jar stock and riders. A vendor’s customers may place orders with that vendor through the Waterzy WhatsApp number.

Waterzy is not a seller of water and is not a party to any sale. Every order is a contract between the customer and the vendor. Waterzy does not set prices, does not deliver, does not handle payment, and does not take a commission. Waterzy is not a marketplace: customers cannot browse or compare vendors, and are connected only to the vendor whose sticker or join code they used.

2. Who may use the Service

• You must be at least 18 years old and able to enter into a binding contract.
• Vendors must be a genuine water-distribution business operating in India and must provide accurate business details.
• Waterzy approves each new vendor account and may decline, pause or suspend an account at its discretion, including for breach of these terms, suspected fraud, or complaints from customers.

3. Vendor accounts

• A vendor signs in with a mobile number and PIN and is responsible for everything done through the account. Keep the PIN confidential and tell us at once if you believe it has been compromised.
• You are responsible for the accuracy of the information you record — customer details, prices, dues, jar balances, deliveries and payments — and for the actions of the riders you register.
• You must have the right to enter your customers’ and riders’ personal data into the Service, and you must use it only to run your water business. You must not send customers marketing, reminders or other messages they have not agreed to receive, and you must comply with the Digital Personal Data Protection Act, 2023 in respect of the data you control.
• Your customers’ records belong to your business and are visible only to you. Waterzy accesses them only to operate, support and secure the Service, as described in the Privacy Policy.
• You are responsible for your own tax, licensing, food-safety and other legal obligations as a water vendor.

4. Ordering through WhatsApp

• Ordering is available only after you scan a vendor’s Waterzy sticker or enter its join code, which connects you to that vendor’s shop. By doing so you agree to receive replies from the Waterzy WhatsApp number about your orders.
• Prices shown are set by your vendor, including any rate the vendor has agreed with you personally. Minimum quantities may apply. Orders cannot be placed while the vendor’s shop is closed.
• An order is a request to your vendor. It is confirmed, changed or refused by the vendor, and your balance changes only when water is delivered or billed, not when you place the order.
• Free-text questions may be answered by an automated assistant. It can tell you only about that vendor’s products and prices, may make mistakes, and does not create commitments on the vendor’s behalf. Buttons are always available as an alternative.
• Waterzy replies only to messages you send. To stop, stop messaging the number or ask for your record to be removed (Privacy Policy, section 9).
• Your use of WhatsApp itself is governed by WhatsApp’s terms of service.

5. Payments

• Payment is made directly by the customer to the vendor — cash on delivery, UPI to the vendor’s own UPI ID, or, where the vendor allows it, credit settled later. Waterzy does not collect, hold, process or refund any payment.
• A UPI payment shown in the app as “unverified” has not yet been confirmed by the vendor. Confirming receipt is the vendor’s responsibility.
• Disputes about price, quantity, quality, delivery, refunds or dues are between customer and vendor. Waterzy may help with records but does not adjudicate or guarantee any outcome.

6. Acceptable use

You must not:

• use the Service for anything unlawful, or to send spam, threats or harassment;
• enter false information, or data about people without the right to do so;
• attempt to access another vendor’s data, probe or overload our systems, or bypass security;
• copy, resell or reverse-engineer the Service;
• use automated tools to message the Waterzy WhatsApp number.

7. Availability and changes

• We aim to keep the Service available at all times but do not guarantee it. Features may change, and some described on our website are planned rather than available.
• The vendor app keeps working without a network connection and sends records later; a record is never applied twice.
• We may update these terms. Continued use after a change means you accept the updated terms. The date at the top shows the current version.

8. Intellectual property

The Service, its software, design and content are owned by Waterzy or its licensors. Vendors keep ownership of the business data they enter, and grant Waterzy a licence to store and process it to provide the Service.

9. Liability

• The Service is provided “as is”. To the extent permitted by law, Waterzy excludes all warranties and is not liable for indirect, incidental or consequential loss, loss of profit, or loss of data.
• Waterzy is not liable for the quality, safety, quantity or delivery of water, for prices, or for payments and dues between customers and vendors.
• Where liability cannot be excluded, Waterzy’s total liability to you for any claim is limited to the amount you paid Waterzy for the Service in the twelve months before the claim, or INR 1,000, whichever is greater.
• Nothing in these terms limits liability for fraud or for anything that cannot be limited under Indian law.

10. Ending the relationship

• A vendor may close the account at any time from the app or by writing to us. Customer records with outstanding dues are retained as described in the Privacy Policy.
• A customer may stop using WhatsApp ordering at any time and may ask for their record to be removed.
• Waterzy may suspend or end access for breach of these terms, and will say why unless the law prevents it.

11. Governing law

These terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Ernakulam, Kerala.
